1. Agreement to Terms

By accessing or using Rplyflow ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Rplyflow is an AI-powered tool that helps Instagram Business and Creator account holders respond to comments more efficiently. The Service:

• Analyzes your Instagram posts to learn your writing style
• Generates suggested replies to comments on your posts
• Posts replies to Instagram on your behalf when you approve them

Important: You maintain full control over all replies. No reply is ever posted without your explicit approval.

3. Account Requirements

3.1 Eligibility

To use Rplyflow, you must:

• Be at least 18 years old
• Have an Instagram Business or Creator account
• Have your Instagram account connected to a Facebook Page
• Have the authority to bind yourself to these Terms

3.2 Account Security

You are responsible for maintaining the security of your account and for all activities that occur under your account. You must immediately notify us of any unauthorized use.

3.3 Account Termination

You may disconnect your Instagram account and delete your Rplyflow account at any time. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree NOT to use Rplyflow to:

• Violate Instagram's Terms of Service or Community Guidelines
• Post spam, harassment, hate speech, or abusive content
• Impersonate others or misrepresent your identity
• Post misleading, fraudulent, or deceptive content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Distribute malware or engage in phishing
• Attempt to circumvent rate limits or abuse the Service
• Resell, redistribute, or sublicense the Service

We reserve the right to remove content or suspend accounts that violate these guidelines.

5. Your Responsibilities

You are solely responsible for:

• Content Review: Reviewing all AI-generated replies before posting
• Content Accuracy: Ensuring replies are appropriate and accurate
• Compliance: Complying with Instagram's policies and applicable laws
• Your Audience: How your replies affect your followers and brand

While our AI strives to generate appropriate replies, you must review each suggestion before approving it for posting.

6. Subscription and Payments

6.1 Pricing

Rplyflow offers a free tier and paid subscription plans. Current pricing is displayed on our website and may change with notice.

6.2 Billing

• Paid subscriptions are billed monthly in advance
• Payments are processed securely through Stripe
• You authorize us to charge your payment method on file
• Failed payments may result in service suspension

6.3 Cancellation and Refunds

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months or unused reply credits
• Reply limits reset at the beginning of each billing period

6.4 Fair Use Policy

The Creator tier (1000 replies/day) is subject to a fair use policy. Automated or excessive usage patterns may result in account review.

7. Intellectual Property

7.1 Our Property

The Service, including its design, features, and technology, is owned by Rplyflow and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

7.2 Your Content

You retain ownership of your Instagram content. By using the Service, you grant us a limited license to access and process your content solely for the purpose of providing the Service.

7.3 AI-Generated Content

Replies generated by our AI become your content once you approve and post them. You are responsible for any content you post.

8. Third-Party Services

Rplyflow integrates with third-party services including:

• Meta/Instagram: Subject to Instagram's Terms of Use
• Stripe: Subject to Stripe's Terms of Service
• Anthropic: Subject to Anthropic's Terms

We are not responsible for the practices or content of third-party services.

9. Disclaimers

9.1 Service Provided "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

9.2 AI Limitations

AI-generated replies may not always be perfect, appropriate, or accurate. We do not guarantee:

• That replies will perfectly match your voice or style
• That replies will be free of errors or inaccuracies
• That replies will be appropriate for all contexts
• Any specific business outcomes from using the Service

9.3 Service Availability

We do not guarantee uninterrupted or error-free service. The Service may be unavailable due to maintenance, updates, or factors beyond our control (including Instagram API changes).

10. Limitation of Liability

To the maximum extent permitted by law, Rplyflow and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, business opportunities, or goodwill
• Any damages resulting from content you post using the Service
• Any damages resulting from unauthorized access to your account
• Any damages exceeding the amount you paid us in the past 12 months

11. Indemnification

You agree to indemnify and hold harmless Rplyflow and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Content you post using the Service
• Your violation of these Terms
• Your violation of any third-party rights

12. Modifications to Service and Terms

12.1 Service Changes

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

12.2 Terms Updates

We may update these Terms from time to time. We will notify you of material changes by posting on our website or via email. Continued use after changes constitutes acceptance.

13. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rplyflow regarding the Service.
